Welcome to PhotoGnome. These Terms of Service (“Terms”) govern your access to and use of the PhotoGnome mobile application (“App”) operated by DeCrosta Development LLC (“we”, “us”, or “our”). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.
1. Eligibility
You must be at least 13 years old to use SmartPhotoAI. By using the App, you represent and warrant that you meet this requirement and that you are legally capable of entering into a binding agreement.
2. Use of the App
SmartPhotoAI is provided for personal, non-commercial use only. You agree not to:
- Use the App for any unlawful purpose
- Attempt to reverse engineer, decompile, or disassemble any part of the App
- Interfere with the proper functioning of the App
- Use automated systems to interact with the App (e.g., bots or scrapers)
We reserve the right to suspend or terminate your access at any time for violation of these Terms.
3. User Content and Photos
SmartPhotoAI allows you to take and save photographs using your device’s camera. You retain full ownership of all photos captured using the App. The App does not upload or store your photos on our servers.
Photos are stored locally on your device or in your iCloud account, depending on your iOS settings. You are responsible for managing, backing up, and sharing your content.
4. Privacy
Please refer to our Privacy Policy for details on how we collect, use, and protect your data. The App may access your device’s camera and photo library with your permission, but we do not collect or store personal images or biometric data.
5. Intellectual Property
All content, features, and functionality in the App, including but not limited to code, design, logos, and branding, are the exclusive property of DeCrosta Development LLC. You may not reproduce, modify, or distribute any part of the App without our prior written permission.
6. Disclaimers
The App is provided “as is” and “as available” without warranties of any kind, express or implied. We do not guarantee that the App will operate without error, that it will capture every photo perfectly, or that it will be available at all times.
Use of the App is at your own risk. We are not responsible for missed moments, data loss, or any unintended consequences related to image capture.
7. Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages arising out of or relating to your use of the App.
8. Modifications to These Terms
We reserve the right to modify these Terms at any time. Any changes will be effective when posted within the App or on our website. Continued use of the App after changes means you accept the new Terms.
9. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.
